This website, www.lacicognaroma.com (the "Site"), is operated by CS Commerciale S.r.l., trading as "La Cicogna Roma". In these Terms & Conditions (the "Terms"), "we", "us", "our" and the "Seller" refer to CS Commerciale S.r.l.

By accessing the Site and placing an order, you accept these Terms in full. Please read and save or print a copy before purchasing.
1. Purpose
The Site offers the online sale of products for infants and young children. These Terms govern the relationship between the Seller and the user of the Site (the "Customer")
2. Definitions
"Consumer" means a natural person acting for purposes outside their trade, business, craft or profession. "Business Customer" means a person purchasing in the course of such activity. Certain protections (in particular the right of withdrawal and the consumer's place of jurisdiction) apply only to Consumers.
3. Products
Products are described as accurately as possible. Images are for illustrative purposes and may show slight differences in colour or material from the actual product, including due to your device's settings. Our products comply with the applicable European safety regulations for children's products.
4. Prices, taxes and duties
Prices are displayed in the currency applicable to your country or region, as shown on the Site and at checkout (for example, Euro for the European Union and US Dollars for the United States). For sales within the European Union, prices include VAT unless otherwise indicated. Shipping costs are shown separately before you confirm your order. If your payment method is denominated in a currency other than the one used for the purchase, your bank or payment provider may apply its own exchange rate and charges, which are beyond our control. For deliveries outside the European Union, your order may be subject to import duties, taxes and customs charges levied by the destination country; these are payable by the Customer and are not included in the price. We may change prices at any time; the price and currency applicable to your order are those displayed when you submit it.
5. Orders and formation of the contract
By placing an order, you confirm that you are at least 18 years old and have the capacity to enter into contracts, and that you accept these Terms in full. An order constitutes an offer to purchase. The contract is concluded when we send you an order confirmation by email or, failing that, when the product is dispatched.
We reserve the right to refuse or cancel an order, with a full refund of any amount already paid, in the following cases: unavailability of the product; obvious errors in price or description; failure to obtain payment authorisation; or suspected fraud or breach of these Terms.
6. Payments
Payments may be made using the methods shown on the Site. Transactions are processed by secure third-party payment providers; we do not store your full card details. Orders are processed after payment authorisation.
7. Shipping
Delivery terms, times and costs are set out in our Shipping Policy. For international deliveries, Section 4 above on duties and taxes also applies.
8. Right of withdrawal and returns
If you are a Consumer resident in the EU/EEA, you have the right to withdraw within 14 calendar days under the Italian Consumer Code. For Customers resident outside the EU (including the United States), we voluntarily grant an equivalent right to return within 14 days. The procedures, conditions and refunds are governed in detail by our Returns & Refunds Policy, which forms an integral part of these Terms.
9. Legal guarantee of conformity
Consumers benefit from the 24-month legal guarantee of conformity under Articles 128 et seq. of the Italian Consumer Code. The relevant procedures are described in our Returns & Refunds Policy.
10. Product use and safety
Our products are intended solely for the use described in the instructions and warnings supplied with the product, which you should read carefully and keep. In particular:

always use the product under the direct supervision of an adult and in accordance with the instructions and warnings provided (if applicable);

do not use the product otherwise than as instructed, or if it is damaged or worn.
We are not liable for damage arising from improper use, use contrary to the instructions, or use that is not reasonably foreseeable. Our liability for damage caused by a defective product under mandatory law is unaffected (see Section 12).
11. Warranties
Without prejudice to the legal guarantee of conformity and any other non-waivable rights granted to Consumers, and to the maximum extent permitted by applicable law, the Site and its content are provided "as is"; we make no further warranties, express or implied, regarding the Site beyond those required by law.
12. Limitation of liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. In particular, we do not exclude or limit in any way our liability for: personal injury caused by our negligence; damage caused by a defective product under applicable law; fraud or gross negligence; or any other liability that cannot be excluded by law, including Consumers' non-waivable rights.
To the extent permitted by law, we are not liable for indirect or consequential damages, loss of profit or opportunity, or for Site interruptions due to causes beyond our control. For Business Customers, and subject to the above, our total liability in connection with an order is limited to the amount you paid for that order.
13. Out-of-court dispute resolution (ADR)
If you have a complaint, please contact us at info@lacicognaroma.it; we will try to resolve any matter quickly and amicably. As a Consumer, you may also refer the matter to the competent alternative dispute resolution (ADR) bodies under the Italian Consumer Code. A list of ADR bodies in the Member States is available on the European Commission's consumer-redress portal (consumer-redress.ec.europa.eu). Your right to bring proceedings before the courts is unaffected.
14. Intellectual property
All content on the Site (trade marks, logo, images, text, graphics) is owned by or licensed to CS Commerciale S.r.l. and is protected by intellectual property laws. Any unauthorised reproduction, distribution or use is prohibited.
15. Use of the Site and accounts
You agree to use the Site in compliance with the law and these Terms, to provide accurate information, and to keep any account credentials confidential. You are responsible for activity carried out through your account.
16. Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control (e.g. natural events, strikes, network or carrier disruptions, acts of authorities).
17. Privacy
The processing of personal data is governed by our Privacy Policy, which complies with Regulation (EU) 2016/679 (GDPR).
18. Changes to the Terms
We may amend these Terms at any time. The version applicable to each order is the one published on the Site when the order is submitted. Changes will be posted on this page with the update date.
19. Sales to Business Customers (B2B)
Consumer-protection provisions (in particular the right of withdrawal and the consumer's place of jurisdiction) do not apply to purchases made by Business Customers. Such purchases are governed by these Terms and by the applicable provisions of the Italian Civil Code.
20. Governing law and jurisdiction
These Terms are governed by Italian law. Disputes with a Business Customer fall under the exclusive jurisdiction of the courts of Rome. For disputes with a Consumer, the mandatory jurisdiction of the courts of the Consumer's place of residence or domicile applies (Article 66-bis of the Italian Consumer Code) and, for Consumers resident in other EU States, the jurisdiction provided by Regulation (EU) 1215/2012. For Consumers resident outside the EU, the application of Italian law does not deprive them of the mandatory protections of the law of their country of habitual residence.
21. Miscellaneous
If any provision is found invalid, the remaining provisions remain in force. Failure to exercise a right does not constitute a waiver of it. You may not assign your rights or obligations without our written consent.
